Good day!

I would like to request the minutes, key summary, or highlights of the meetings held by the Fiscal Incentives Review Board (FIRB) after the effectivity of the Corporate Recovery and Tax Incentives for Enterprises (CREATE) Act. The information that will be provided will be exclusively used for my research about the law and the Strategic Investment Priority Plan (SIPP). 

Please let me know if the document requested would be covered by the exceptions under Executive Order No. 2, s. 2016.

With respect to your request for minutes, key summary, or highlights of the meetings held by the Fiscal Incentives Review Board (FIRB) after the effectivity of CREATE, we regret to inform you that the rule on deliberative process privilege applies, pursuant to Executive Order No. 2, series of 2016.    Under this rule, the following information are not covered by the Freedom of Information (FOI):

   a.	advisory opinions, recommendations, and deliberations comprising part of 
        a process by which governmental decisions and policies are formulated 
        inter-agency recommendations or communications during the stage when 
        common assertions are still in the process of being formulated or are in the 
        exploratory stage; or information pertaining to the decision-making of 
        executive officials; and 
   b.	information, record, or document comprising drafts of decisions, orders, 
        rulings, policy decisions, memoranda, etc.

We suggest that you write the Board of Investments (BOI) for particular concerns about the SIPP. The BOI has the technical expertise on matters related to the SIPP and is the lead agency in formulating the SIPP.
