Hi! I would like to request information regarding if 365 the ONLY divisor to use in determining the daily wage rate of monthly paid employees as per DOLE handbook? Or it’s merely a guide and it’s still company prerogative?

Thank you for your request dated Jul 27, 2023 03:56:48 PM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

Your Request

You asked whether 365 is the only factor to be used in computing the salary of monthly-paid employees. 

Response to Request

Your FOI request is approved. We answer in the affirmative. Please be informed that the factor 365 days in a year is to be used in determining the equivalent monthly salary of monthly-paid employees. Monthly-paid employees are those who are paid every day of the month, including unworked rest days, special days, and regular holidays. 


Your right to request a review

If you are unhappy with this response to your FOI request, you may ask us to carry out an internal review of the response by writing to  Exec. Dir. Maria Criselda R. Sy. Your review request should explain why you are dissatisfied with this response, and should be made within 15 calendar days from the date when you received this letter. We will complete the review and tell you the result within 30 calendar days from the date when we receive your review request.

If you are not satisfied with the result of the review, you then have the right to appeal to the Office of the President under Administrative Order No. 22 (s. 2011).
