hi magandang gabi may inireklamo kami sa baranggay pero hindi ito sumipot binigyan na kami ng cfo ng barangay para makapag sampa kami ng kaso nasabi ko sa attorney ng pao na may kaso na rin sa barangay ang taong inirereklamo namin sabi niya humingi daw kami ng kopya ng report pero pagpunta namin sa barangay hindi daw pwede d public records iyon ang tanong ko lang totoo po ba ito salamat po

Your Request

You asked for Barangay Report or Blotter.

Response to Request

Your FOI request is approved. Based on your query, you are requesting clarification whether a blotter/incident report of a Barangay is a public document or not. 

In the outset, Barangay incident report are public document that can be accessed by a party specifically those involved in the incident. The requesting party may request copies of the blotter from the Secretary of the Lupong Tagapamayapa as stated in the Local government Code, Sec. 404, quote:

..." The lupon secretary shall issue certified true copies of any public record in his custody that is not by law otherwise declared confidential..."

Such report may be used to file a formal charge to the accused or refute any claims by another party. 

While there are cases that request for a copy of the report/blotter may be denied due to confidentiality reasons, in this case, since the requestor is a party involved in the incident, it would be amiss if the request is denied. 

Your right to request a review

If you are unhappy with this response to your FOI request, you may ask us to carry out an internal review of the response by writing to Sec. Benjamin Abalos, Jr., DILG-NAPOLCOM Center, Quezon Ave., Quezon City. Your review request should explain why you are dissatisfied with this response, and should be made within 15 calendar days from the date when you received this letter.
