You asked for Hazard Pay and Night Differential Pay.

Thank you for reaching out regarding Hazard Duty Pay and related concerns. Hazard Duty Pay is a compensation premium or allowance designed for officials and employees exposed to workplace hazards due to the nature or location of their work.

Regarding hazard pay for prison guards, we kindly direct your attention to the Bureau of Jail Management and Penology (BJMP), as the Department of Labor and Employment (DOLE) does not have jurisdiction over them.

In addressing the night differential pay for government security guards, it is important to note that most of these guards are typically outsourced. The computation of their night differential pay aligns with the standard applied to private-sector employees.

Every private sector employee is entitled to a Night Differential or Night Shift pay, amounting to not less than 10% of their regular wage for each hour of work performed between 10 pm and 6 am. The calculation for ordinary day-night differential is as follows: Ordinary Day Night Differential = (Hourly rate × 10% × 8 hours). Special cases, such as Rest Day Night Shift, Special Holiday Night Shift, Special Holiday and Rest Day Night Shift, Regular Holiday Night Shift, Double Holiday Night Shift, etc., may have variations in computation.

For security guards directly hired by the government, their night differential pay is governed by guidelines set forth by the Civil Service Commission (CSC) and the Department of Budget and Management (DBM). We recommend coordinating with these agencies for specific details on this matter.
