Hi, I would like to request if there are any memos from Department of Labor still requiring applicants for job to have a vaccination card for Covid19. Or if the previous memos are still in effect up to this date?

Thank you for your request dated Feb 02, 2024 06:46:36 AM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

You asked for Covid19 vaccination requirement for job application..

 
Please be guided that although employers have management prerogative on how to implement their Occupational Safety and Health (OSH) Programs including programs relative to the prevention and control measures against COVID-19, such actions must comply with relevant laws, rules, and regulations.  Republic Act 11525 or the “Vaccination Law” states that vaccine cards shall not be mandated for employment. It is important to note as well that Presidential Proclamation No. 297 has lifted the state of public health emergency due to COVID-19.  

Furthermore, Labor Advisory No. 3, Series of 2021 provides that the policy of "no vaccine, no work" in the workplace is prohibited. In response to your query, employers are not permitted to require applicants to be vaccinated before considering their application.
