Hi! I would like to request for information regarding:

Is it legal to have swap all the Philippines annual holidays (Jan 1 to Dec 31) to foreign holidays (regular working days for the Philippines) without holiday premium pay?

Dear Kisoo Kim,

Thank you for your request dated Feb 02, 2024 01:30:43 PM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

You asked for Paternity leave in the Philippines.

As per, RA 8187; Notwithstanding any law, rules, and regulations to the contrary, every married male employee in the private and public sectors shall be entitled to a paternity leave of seven (7) days with full pay for the first four (4) deliveries of the legitimate spouse with whom he is cohabiting.

REPUBLIC ACT NO. 11210 Expanded Maternity Leave provides for an additional 7 days, in the event that you opt to utilize the option of transferring leave credits from your spouse, you will qualify for a combined 14-day duration of paternity leave.

While RA 8187 only provides paternity leave for the first 4 deliveries the EML availment of transfer leave is unlimited.
