Good day,

May I ask if a subcontractor working in s company (with high risk workplace classification) should assigned solely as SO2 or can one of the workers can also act as SO2 while performing other (operation) duties? This is assuming the total number of workers is nine (9).

Thank you for your request dated Jan 16, 2024 01:43:38 PM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

You asked for SO2 working in High Risk workplace.

May we provide you a copy of Department of Labor and Employment's (DOLE) Department Order No. 198, Series of 2018, which is also known as the Implementing Rules and Regulations (IRR) of the Occupational Safety and Health (OSH) Law.

Section 14 of the mentioned regulation requires establishments classified as high-risk to provide a safety officer who will supervise fully the high-risk activities of the establishment. The presence of a dedicated safety officer is instrumental in ensuring strict adherence to safety protocols and standards, thereby promoting a secure and healthy working environment for all employees.
