Dear Maria Monica Lascano,

This is in reference to your FOI request to obtain a list of the companies who have violations concerning the Occupational Safety and Health Standards (OSHS).

Upon the assessment of your request, the requisition of data involves the privacy of the companies, which clearly requires their consent.  Additionally, this office acknowledges that we are not in the position to decide for them, hence, the absence of our jurisdiction.

Due to this reason, we regret to inform you that this office will not be able to provide the list you have requested due to the Office's strict adherence to Republic Act 10173 otherwise known as the Data Privacy Act of 2012.

If you are unhappy with this response to your FOI request,  you may ask us to carry out an internal review of the response by writing to Secretary Bienvenido E. Laguesma at DOLE Building, Muralla St., Intramuros, Manila. Your review request should explain why you are dissatisfied with this response, and should be made within 15 days from the date when you received this letter. We will complete the review and tell you the result within 30 calendar days from the date when we receive your review request.

If you are not satisfied with the result of the review, you then have the right to appeal to the Office of the President under Administrative Order No. 22 (s. 2011).
