APE Requirement

Requested from DOLE by C. Shane at 03:40 PM on Jan 18, 2024.
Purpose: Concern
Date of Coverage: 01/16/2024 - 01/18/2024
Tracking no: #DOLE-495511316932

Shane 03:40 PM, Jan 18, 2024

Good day, ma’am/sir!

Can you please clarify my concern? Since it is required for employees of private companies in the Philippines to have Annual Physical Examination (APE), according to DOLE, who should shoulder the fee?

My company gave a memo stating that fees should be paid by us, employees. Is it legal? If not, what should be my next step?

Thank you.

Dear Crystelle Shane,

Greetings!

Thank you for your request dated Jan 18, 2024 03:40:36 PM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

Your Request

You asked for APE Requirement.

Response to Request

Per our Occupational Safety and Health Standards (OSHS) specifically at Rule 1967, number (2), item b, "All workers irrespective of age and sex shall undergo physical examinations and all examinations shall be rendered free of charge to workers."

The Law in this case is clear. Not only shall APEs be required, but shall also be at no expense to workers. Hope this clarifies things up.
