Hi i would like to request a redundancy from my previous work 

1. Previous work has recently face some significant challenges in their production

 2. They undergo a reduction in workforce.

Thank you for your request dated Jan 16, 2024 09:22:21 AM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

You asked for Redundancy.

In the Philippines, employers are expected to formally declare redundancy, and the termination must adhere to specific procedures outlined by labor laws. Redundancy is considered a valid reason for termination when it results in the involuntary loss of employment, and neither the employer nor the employee is at fault. Typically, this situation arises when an employee's skills become surplus to the company's needs.

When an employer declares redundancy, Article 298 of the Labor Code stipulates that the affected employee is entitled to receive separation pay. This separation pay should be equivalent to at least one (1) month's pay or at least one (1) month of pay for every year of service, depending on whichever amount is higher.

This provision is designed to ensure that employees who find themselves in such situations are provided with fair compensation as they transition to new opportunities.
