Good day,

The bidding project is Entitled: Supply and Delivery of customized T-Shirt 

The Instruction to Bidders clearly states "No subcontracting allowed"


Upon post qualification, it was noticed that the lowest calculated bidder is a sole proprietor with only 2 employees ( driver and sales man). Thus, circumstances revealed that the LCB is a middle man, and has no production site, thus only engaging in buy and sell of products.

Question: Will he be considered LCB and RESPONSIVE Bidder?

What are the legal implications and legal remedy if the agency still proceed with the Contract.
