October 5, 2023 Dear Citizen, Greetings! Thank you for your request dated Mar 09, 2021 07:52:37 AM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch. Your request In compliance with Executive Order No. 2, s. 2016, and by virtue of Special-Order No. 019-2021, the undersigned has reviewed the FOI Request made by Mr. John Mark Jimenez requesting the Commission for the following: 1. Data regarding the government’s approval on the conduct of demolition in some urban poor areas during the pandemic. The prober is requesting the said information for his academic requirements. It is the opinion of the undersigned that the request of the prober is a request for public information which falls within the ambit of Executive Order No. 2, s. 2016. However, the Commission is not the proper custodian of the above-mentioned information. As such, it is deemed best, pursuant to the “No wrong door” policy of the Freedom of Information Act that the prober be referred to the appropriate government agency which has the custody of such information. In this regard the undersigned deems it proper that the prober be referred to the Department of Interior and Local Government (DILG) which can provide the prober the necessary information regarding the process for the conduct of demolition. Therefore, it is the recommendation of the undersigned that the Request for Information may be DENIED, and that the prober be referred to the appropriate national government agency, which has the custody of the subject information being requested.
