Good day.

I would like to request for a copy of a document/agreement  between the Parole and Probation Office and the National Bureau of Investigation-Clearance Section/Philippine National Police regarding the deletion of criminal record in the clearances once the period of probation has been terminated.

I work at the Public Attorney's Office and would like to give my clients proper legal advise.  According to the Probation Office in Mandaluyong, there is such an agreement, which will be beneficial for those who follow the terms and conditions of their probation.

You asked for a Memorandum of Agreement between Parole and Probation Administration and NBI.


Response to Request

Your FOI request is approved. I enclose a copy of the first page of Memorandum Circular No. 6,  series of 2020, with the subject, "Guidance on the Termination or Completion of Probation." The memorandum attached the legal opinion of the Secretary of Justice clarifying that there is no deletion of criminal records in probation hence the absence of a memorandum of agreement between NBI and PPA on the deletion of a criminal record in clearances.

The rest of the Memorandum mentioned could not be attached to this message so we will send the whole memo to the email you indicated here in your request.
