Hi,

I would just like for an update on the PCC's probe on possible collusion due power plant shutdowns that led to rotating brownouts last May 31, June 1. At what stage is the investigation now? When does PCC hope to complete its investigation?

This has reference to your request dated 02 July 2021 and received on same date, denominated as a Freedom of Information (“FOI”) Request under Executive Order (E.O.) No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

In your request, you asked for an update on the Philippine Competition Commission’s (“PCC”) probe on the possible collusion on power plant shutdowns that resulted to rotating brownouts, specifically on the status of the investigation and date of its possible completion, for media research. 

Response to Your Request

Your request for information is DENIED.

The requested information is one of the exceptions to the right of access to information. Pursuant to the Memorandum from the Executive Secretary dated 24 November 2016, providing for the Inventory of Exceptions to Executive Order No. 2, series of 2016 and Section 3(g), Rule IV of the Rules Implementing the Code of Conduct and Ethical Standards for Public Officials and Employees, access to information shall be denied when the release of the information will affect the implementation of an official act, to wit:

“For the implementation of the exceptions to the right of access to information, the following provide the salient details and legal bases that define the extent and application of the exceptions:

6. Information of which a premature disclosure would:

b. be likely or significantly frustrate implementation of a proposed official action, except such department, office or agency has already disclosed to the public the content or nature of its proposed action, or where the department, office or agency is required by law to make such disclosure on its own initiative prior to taking final official action on such proposal. 

Any release of additional information on this matter, other than those previously communicated by the PCC, would result to a premature disclosure which would eventually and significantly frustrate the PCC’s exercise of its official powers and functions.
