Greetings!

Thank you for your request dated Feb 20, 2019 09:25:04 AM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

Your request
 
In your request, you asked for: (1) a copy of the Philippine Competition Commission’s (“PCC”) Memorandum of Agreement (“MOA”) with the Public-Private Partnership Center (“PPP Center”); and (2) information regarding “the existence of Merger Notification Guidelines for PPPs”. 

Response to your request

As regards your first request, considering that the requested document does not fall under any of the Exceptions under E.O. No. 2, s. 2016 and under the PCC FOI Manual, your request has been approved. Please see attached copy of the PCC’s Memorandum of Agreement with the PPP Center. 

As regards your second request, the PCC has not yet issued any Merger Notification Guidelines for PPPs. However, kindky be advised that the PCC is currently drafting a Memorandum Circular for the Notification of PPP Projects. The said document is currently pending review by the PPP Center.
