This has reference to your request dated 14 February 2020, denominated as a Freedom of Information (“FOI”) Request under Executive Order (E.O.) No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

You requested for three (3) certified true copies of the Position Paper dated 27 May 2019 submitted by the Philippine Competition Commission (“PCC”) to the Tariff Commission, in relation to the imposition of safeguard measures in “In the Matter of the Definitive General Safeguard Measure on the Importation of Cement from Various Countries (AHTN Codes 2523.29.90 and 2523.90.00) (Safeguard Measures Case No. 01-2018).” 

Response to your request 
Considering that the requested document does not fall under any of the Exceptions under E.O. No. 2, s. 2016 and under the PCC FOI Manual, your request has been approved. 

We note, however, that PCC’s Position Paper dated 24 May 2019 on the Formal Investigation on the Imposition of Safeguard Measure Against Importation of Cement from Various Countries was for Investigation No. SG-2019-OC-Cement and was received by the Tariff Commission on 27 May 2019. 

Please see attached the scanned certified true copy of the Position Paper and its cover letter dated 24 May 2019.  You may pick up the printed copies at PCC’s office located at 25/F Vertis North Corporate Center 1, North Avenue, Quezon City.
