I like to know about using rights of using Sikaran as a generic Filipino term for kicking so nobody is entitled for its exclusive use or it is registered and protected by Intellectual property office of the Philippines.
I Also like to know if any one can registered as trademark for any generic Filipino terms and use it for the personal agenda.

Dear Mr. Banaag:

This letter is in connection with your query regarding a Filipino term “Sikaran” which we received through the eFOI portal on February 21, 2019.

While we consider your query not falling under the FOI, please be informed that unless an application is filed before the Office we cannot pass upon the registrability of a mark lest we pre-empt the findings of the Trademark Examiner.

For guidance, client or applicant may refer to Section 123 of Republic Act 8293, otherwise known as the Intellectual Property Code of the Philippines, which provides for non-registrable marks. You may visit our website which contains downloadable forms and the trademark regulations.
